Former Cabinet Secretary Raphael Tuju has been granted anticipatory bail by the High Court following his dramatic arrest, even as concerns grow over his health condition at Karen Hospital where he is reportedly under police watch.
The court issued the orders amid claims by opposition leaders led by Kalonzo Musyoka that Tuju is in critical condition and undergoing medical scans to assess possible spinal injuries allegedly sustained during a forceful arrest by police officers.

Justice Martin Muya granted Tuju anticipatory bail of KSh 200,000, with one surety or an equivalent cash bail, after an urgent application filed by his lawyer Gregg Ndege.
In his ruling, Justice Muya directed that the matter be mentioned on April 7, 2026, for further directions.

According to court filings, Tuju’s legal team argued that his arrest and continued detention were unlawful and violated his fundamental rights, including dignity, liberty, and access to proper medical care.
“The ongoing police presence and control over him at the hospital is inhumane, unjustified, and violates his rights,” the application states.
Lawyer Ndege urged the court to intervene urgently, warning that failure to grant the orders would expose his client to significant prejudice.
The court certified the matter as urgent, naming the National Police Service Inspector General, the Directorate of Criminal Investigations, and the Office of the Director of Public Prosecutions as respondents.
Tuju was arrested on Monday evening at his Karen home, hours after resurfacing from a reported 36-hour disappearance that his family had described as an alleged abduction.
Earlier, Kalonzo, alongside Eugene Wamalwa and lawyer Ndegwa Njiru, visited Tuju at the hospital and raised alarm over his condition.
Kalonzo also criticized the continued police presence at the facility, calling for the immediate withdrawal of officers and respect for Tuju’s rights.
He further challenged President William Ruto to intervene, linking the incident to broader concerns over alleged land disputes and urging an end to what he termed as “daylight land grabbing.”
The leaders also commended the Karen Hospital medical team for their professionalism as Tuju continues to receive treatment.
