A 54-year-old man has been arrested in Kiminini, Trans Nzoia County, after a 35-year-old mentally challenged man died from injuries sustained in an alleged mob attack after he was mistaken for a thief.

The Directorate of Criminal Investigations (DCI) said detectives arrested Joseph Apollo following an intelligence-led operation in Milimani Location, Kiminini Sub-County, where the incident occurred.

The victim, identified as Dennis Imboha, reportedly wandered away from his home before ending up at a neighbouring homestead.

According to the DCI, Imboha was allegedly mistaken for a thief and subsequently attacked by a mob.

He suffered multiple serious injuries during the assault and was rushed to Kijana Wamalwa Hospital for treatment.

Despite efforts to save his life, the 35-year-old man reportedly succumbed to his injuries while receiving medical care.

The circumstances surrounding Imboha's death have now become the subject of a police investigation, with detectives working to establish what happened before, during and after the alleged assault.

Following the incident, detectives visited the scene and collected evidence as part of investigations into the suspected murder.

The DCI said Imboha's body was preserved at the hospital mortuary pending an autopsy.

The post-mortem examination is expected to help investigators establish the nature and extent of the injuries sustained by the deceased.

Suspect arrested in Kiminini

Detectives later conducted an intelligence-led operation in Milimani Location, resulting in the arrest of 54-year-old Joseph Apollo.

The suspect is currently undergoing processing ahead of his arraignment in court.

The DCI has, however, indicated that investigations are not over.

“Investigations are ongoing,” the agency said, noting that detectives are pursuing additional leads.

Investigators are expected to establish whether other people were involved in the alleged attack that left Imboha dead.

DCI warns against mob justice

The death has also renewed the warning against mob justice, with the DCI urging Kenyans not to take the law into their own hands.

The agency said members of the public should allow suspected criminals to be arrested and taken through the legal process instead of attacking them.

“Members of the public are, once again, reminded to refrain from taking the law into their own hands and to let the law take its due course,” the DCI said.

The warning comes amid continued concerns over cases where members of the public attack people based on suspicion that they have committed crimes.

Dennis Imboha was 35 years old and had reportedly been living with a mental health challenge.

According to the DCI, he had wandered away from his home before inadvertently finding himself at the neighbouring homestead in Milimani.

He was subsequently subjected to the alleged assault that left him with severe injuries.

His death has left his family and loved ones mourning as detectives continue investigating the circumstances surrounding the incident.

DCI seeks more information

The DCI said it is pursuing additional leads as it works to establish the full circumstances surrounding Imboha's death.

The agency also conveyed its condolences to the deceased's family, friends and loved ones.

“The DCI remains firmly committed to uncovering the full circumstances surrounding his death,” the agency said.

The agency added that every person found culpable would face the full force of the law.

Joseph Apollo remains a suspect, and the allegations against him have not been tested or determined by a court.

The investigation could also lead to further arrests if detectives establish that other individuals participated in the fatal assault.
